TEKIO Sp ZOO (hereinafter ‘Tekio’) is a company based in Poland, 01-871 Warsaw, Jana Kasprowicza 48/41 represented by Jan Estrada-Osmycki and Karolina Zawadzka, NIP: 1182283575, REGON 528529418, e-mail: info@tekio.work

  1.  Tekio offers for sale licensing of fonts and products via its website: store.tekio.work
  2. Terms and Conditions of sale (‘Terms’) are always available at store.tekio.work and constitute the legal basis that governs the use of the store.tekio.work online store, including the rules for making purchases, complaint procedures, as well as the rules for the provision of services by electronic means within the meaning of the act of 18 July 2002 on providing services by electronic means.
  3. The special provisions of the EULA apply to the licensing of typefaces.
  4. The sale agreement is concluded in English.

DEFINITIONS

TERMS and CONDITIONS (‘Terms’) constitute the legal basis that governs the use of the Tekio online store, including the rules for making purchases, as well as the rules for the provision of services by electronic means within the meaning of the act of 18 July 2002 on providing services by electronic means.

CUSTOMER a natural person with full legal capacity, a legal person, or an organizational unit without legal personality that is able to acquire rights and assume obligations, that make purchases at the Store. Customers may also be individuals who have partial legal capacity to acquire rights and assume obligations by themselves in accordance with generally applicable law;

CONSUMER a Customer who is a natural person and who, in the Store, makes a legal transaction that is not directly related to their business or profession within the meaning of article 22.1 of the Polish Civil Code;

PRODUCT the subject matter of the Sale agreement (as defined herein) concluded through the Store

DIGITAL PRODUCT a set of fonts with copyright parameters distinguishing it from other fonts, in electronic form (.otf and/or .woff, and/ or .woff2, and/ or .ttf); each set of fonts is a work within the meaning of the act of 4 February 1994 on copyright and related rights (consolidated text of 2016, item 666);

ORDER an order placed in the tekio.work Store using the Shopping Cart tab.

PRICE all prices displayed on tekio.work are given as net prices, excluding VAT, expressed in EUR. Any additional costs are specified separately at the checkout. Additional fees may apply including costs of shipping.

SHOPPING CART a tab on the Store’s website, which is an integral part of the Store, where the Customer sees the Products they have selected for purchase and has the ability to modify the Order.

PAYMENT acceptable means of payment by the Customer for the price of the Product that is the subject of the Sale agreement using electronic payments, or credit card payments using services provided by the following entities:

  1. PayPal
  2. Visa
  3. Mastercard
  4. American Express
  5. Apple Pay

DISTANCE CONTRACT an agreement concluded between the Customer and the Seller through the Store, under these Terms and Conditions, which is the basis for the purchase of Products by the Customer from the Seller; the agreement is concluded in English.

PLACING AN ORDER, CONCLUDING A CONTRACT

  1. Add a Product to the Shopping Cart
  2. Proceed to ‘Order summary & licensing’
  3. Specify your company size
  4. Confirm that you read the Terms of Service, by clicking on the checkbox
  5. Click on the ‘Check out’ button
  6. Fill out the payment details and billing address
  7. Confirm the payment by clicking on the ‘Pay now’ button

DELIVERY PERIOD The delivery period is related to the method of a delivery and type of product. A Digital Product is delivered immediately via electronic mail. The Customer shall inform the Store about not receiving the Digital Product by sending an e-mail with the order number to info@tekio.work

RIGHT TO WITHDRAW FROM THE PURCHASE AGREEMENT

  1. A Customer who has concluded a Distance Contract with the Seller has the right to withdraw from the contract for the purchase of a physical item without giving a reason within 14 days from the date of taking possession of the item by the Customer or a third party indicated by him, other than the carrier.
  2. To withdraw from the distance contract, the Customer must, within 14 days of delivery of the goods, inform the Seller about his decision to withdraw from the contract by means of an unambiguous statement - should be sent to the e-mail address: info@tekio.work
  3. In the event of withdrawal from the contract, the Customer shall immediately return the goods to the Seller at his own expense - no later than within 14 days of being informed of the withdrawal.
  4. The Customer bears the direct costs of returning the item.
  5. The Seller returns the price to the consumer immediately, no later than within 14 days from the date of receipt of the goods or proof of its return.
  6. The Customer is responsible for reducing the value of the item resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
  7. The right to withdraw from a distance contract for the purchase of Digital Product within 14 days does not apply to the Customer in relation to a contract for the supply of digital content delivered on an intangible medium – prior to purchasing our Product, you consent to the delivery of digital content on an intangible medium before the expiration of the withdrawal period from the agreement. Consequently, upon receiving the Digital Product, you do not have the right to withdraw from the agreement.

RETURNS AND WARRANTY

  1. The Seller undertakes to provide the Customer with a Product or Digital Product that is free of defects.
  2. In the event of a defect occurring in a Product or Digital Product purchased at the Seller’s Store, the Customer has the right to make a complaint based on the provisions of the Civil Code.
  3. The Complaint must be submitted in writing or electronically to the Seller’s addresses provided in these Terms and Conditions. The Customer, along with the complaint, should provide the Seller with the faulty Product or Digital Product for inspection.
  4. The Seller will respond to the claim without delay, no later than within 14 days, and if the Seller fails to do so within this period, it shall be understood that the Customer’s complaint has been deemed justified.

PERSONAL DATA

  1. The Seller is the administrator of the personal data of the Customers collected through the Store.
  2. Personal data is protected in accordance with the act of 29.08.1997 on the protection of personal data (Journal od Laws of 1997, No. 133, item 883).
  3. Personal data is processed in the Store in accordance with the provisions of the act of 29 August 1997 on the protection of personal data and the act of 18 July 2002 on the provision of services by electronic means for purposes related to conducting commercial activity. Data is processed for the time it takes to complete the contractual obligations through the store.
  4. The Customer has the right to access, correct, and delete their data.

FINAL PROVISIONS

In matters not regulated in these Terms, the provisions of Polish law shall apply, in particular the Civil Code and the provisions of the Act on special conditions of consumer sales and amendments to the Civil Code of July 18, 2002 (Journal of Laws 2001, No. 144, item 1204) and the provisions of the Act on consumer of May 30, 2014 (Journal of Laws of 2014, item 827, as amended); and other relevant provisions of generally applicable law.


End User License Agreement

This End User License Agreement (EULA), between you (hereinafter referred to as the "Licensee") and TEKIO Sp ZOO, having its registered office at Jana Kasprowicza 48/41, 01-871 Warszawa, NIP 1182283575, REGON 528529418 (hereinafter referred to as the "Supplier"), governs the utilization of the Font Software and its associated fonts. By downloading or employing the Font Software, you acknowledge that you have understood, read, and agreed to comply with the terms and conditions outlined in this EULA.

OWNERSHIP OF COPYRIGHT

The Font Software is the exclusive proprietary asset of Tekio. Its structure, organization, and code constitute valuable trade secrets of Tekio. All intellectual property rights related to the Font Software are retained by Tekio, and no transfer of ownership takes place under this EULA. Except for the rights explicitly granted herein, all other rights are reserved by Tekio.

LICENSE GRANT AND RESTRICTIONS

Tekio grants you a limited and non-exclusive license to install and use the font software within your organization. You are expressly prohibited from sublicensing, selling, lending, or leasing the font software. However, you may transmit a copy of the font software to a printer or service provider for final output, provided that they destroy any copies upon completion of the work and are duly informed of the terms of this EULA. Additionally, you may not convert, modify, or rename the original font software, open it in an editing software to reveal its structure, or use it to create derivative products or designs.

STANDARD/MULTI-USER LICENSE

The Standard/Multi-User License allows the License to use the Font Software in the following fields of exploitation: creating projects for print and web, designing websites and applications, using them in ebooks. The purchase of a license is required by the organization that will use the font in its communication or will create works or products containing this font. The license cost is calculated for five organization size ranges: 1, up to 5, up to 10, up to 50, and up to 100 employees. The Licensee is required to confirm the number of people employed in the organization at the time of purchase. The Licensee is allowed to install Font Software on an unlimited number of devices in the organization. If you want to use the font in broadcasting, a product with a circulation exceeding 100,000, or if the licensing organization has more than 100 employees, please contact us at: info@tekio.work.

COMPATIBILITY AND USAGE

Tekio provides OpenType/CFF (.otf) desktop font formats, along with other specified file formats. Tekio ensures the validity, installability, and printability of the font software downloaded from its website. However, compatibility and support for OpenType fonts and features may vary depending on systems, software versions, or browsers.

PURCHASING FONT FILES ON BEHALF OF A CLIENT/ PROVIDING FONT FILES TO THIRD PARTIES

Tekio allows the purchase of font software on behalf of a client under certain conditions, including acceptance of the EULA and provision of the original invoice. The font software may be provided to printers and web developers for specific projects within defined time periods, subject to restrictions on use and distribution outlined in the agreement. Freelance designers creating projects for clients use fonts under the license acquired by or for the client.

SELF-HOSTING EMBEDDING: SPECIFIC LAWFUL USE

End-users are granted the right to embed fonts in various digital projects, subject to certain conditions, including possession of a license and restrictions on embedding for creating new documents or designs. Tekio may introduce additional authorized embedding in the future, with specific guidelines provided for different types of digital projects.

WARRANTY AND LIABILITY

Tekio warrants that the font software will perform according to published specifications and may be exchanged if defective within 14 days from purchase. However, Tekio shall not be liable for consequential, incidental, or special damages, nor for claims by third parties.

FREE TRIAL

Designers may utilize Tekio's Free Trial Files for testing purposes only, subject to restrictions on embedding and usage for commercial projects. A license is required once materials are created for a client using the trial fonts. Exceptions are made for students, permitting non-commercial use for academic projects. By downloading free trials, the user expressly agrees to subscribe to our newsletter and receive marketing, promotional, and informational communications from us. Users may unsubscribe from these communications at any time by following the unsubscribe instructions included in each email or by contacting us directly.

APPLICABILITY, TERMINATION, AND DISPUTES

This Agreement is applicable worldwide and remains in effect indefinitely, terminating automatically upon failure to comply with its terms. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of Polish law. Tekio reserves the right to update the EULA without prior notice, and users are advised to review it regularly.
